NJ.com: Some Dufault Charges Downgraded, But Not Sexual Assault Charges

A judge has downgraded some charges against Columbia High School teacher Nicole Dufault, who is was indicted in February on 40 counts of aggravated sexual assault and endangering the welfare of a child, with regard to six male students, according to a report from NJ.com. The sexual assault charges against Dufault still stand as originally charged.

Superior Court Judge Michael L. Ravin denied a defense motion to dismiss the child endangerment charges against Dufault but agreed to downgrade some of the charges from second- to third-degree crimes, according to NJ.com.

DuFault, age 35, was arrested last September at her Caldwell home and charged with engaging in sex acts with five male students. A sixth victim was identified later. The boys, all students at Columbia High School, were between 14 and 15 years old at the time of the alleged incidents.

In June, Dufault’s attorney filed a motion to dismiss the child endangerment charges.
